Terms of Agreement --------------------------------- The words “you” and “yours” refers to buyer, customer name or client as applicable and “we”, “our” or “ours” refers to SCULPT, LLC. AGREED PRICE FOR SERVICE PLAN consists of the total amount of monthly payments plus applicable taxes. Amounts paid are not refundable. You agree to pay any new, additional or increased taxes imposed on this contract. ONE-ON-ONE PERSONAL TRAINING PLAN. The program provides fitness instruction sessions designed to help achieve the Client’s fitness goals. The number of total sessions purchased are noted above, all of which must be completed at rate of 8 per month beginning on the date of the contract. The sessions are not transferable. The sessions do not rollover to other months. The sessions not used within each month will be forfeited. Purchase of the Program does not provide Client with any privileges except as specifically described in this contract, nor does it include the use of, or access generally to, any club, facility, activity, class, program, or equipment, the privilege of which may be separately purchased. There are no refunds for Personal training sessions not used within the required period described above. Late arrival for sessions will result in forfeiture of the missed session time. Sessions which are not cancelled at least 24 hours in advance of their scheduled time will be forfeited. Clients must verify completion of each Personal Training session by entering their PIN code on any available terminal before the beginning of each session. Sculpt, LLC reserves the right to replace your personal trainer with another qualified trainer without prior notice. SCULPT, LLC can not guarantee specific times for appointments. AUTOMATIC PAYMENT PLAN. You agree to make payments of Your Agreed Price For Service, all other charges permitted under this Contract and all applicable taxes through the Automatic Payment Plan. The processing of Your first payment made on the Automatic Payment Plan may be delayed up to seven days. You affirm that You are an authorized signatory of the account specified below. If You have elected the Automatic Payment Plan, You are authorizing SCULPT, LLC, and/or its agents, to make charges or withdrawals to the accounts you have specified for the Agreed Priced For Service, tax payments and all other charges permitted under this contract. If You notify us that You choose to prepay the outstanding balance of Your Personal Training fee, We may charge or withdraw from Your account for the amount of such balance. If for any reason You do not continue to pay Your personal training fee through an Automatic Payment plan, You agree to make payments through our PRE-PAYMENT OPTION. Your Automatic Payment Plan election will remain in effect unless and until all amounts due under this Contract are paid in full or until You give written notice that You revoke this authorization to us at the address noted at the bottom of this page or to Your card issuer. You agree that We must have a reasonable opportunity to act on that notice. You further agree to pay on demand all of Our expenses in connection with any default in the payment of the Automatic Payment Plan, for any reason whatsoever, and all of Our expenses incurred in connection with the collection of any such payments and all other charges permitted under this Contract, or in connection with the exercise, preservation or enforcement of any of Our rights or remedies hereunder, including, without limitation, court costs, fees of Our legal counsel and the allocated costs of accounting, consulting, brokerage or other similar professional fees or expenses.
